These terms were last updated on 2025-04-28, and apply to rental agreements signed via Epicasa from this date onwards.
Epicasa SL provides a digital marketplace for long-term rental properties, enabling users to advertise listings, communicate, and sign rental agreements. Epicasa facilitates the rental process but is not a party to any rental agreement.
By using the Service, you accept these terms and agree to comply with them. If you register a company as a user, you certify that you have the authority to bind the company to these terms.
To provide the Service, Epicasa may charge a service fee ("Service Fee") added to the rental amount.
As a user of the Service, you agree that:
a) Epicasa is not a party to any rental agreement;
b) Epicasa does not undertake any brokerage assignment;
c) Epicasa is not a real estate broker, rental broker, agent, or insurer;
d) Epicasa does not own, manage, or administer real estate;
e) Epicasa does not process, handle, or store user payments.
All payment processing services are provided by Stripe. Stripe handles rental payments, service fees, and deposits. Epicasa has no access to or control over user funds. By using the Service, you also agree to Stripe's terms of service.
Please note that all commitments and/or guarantees made by the tenant in these terms are towards the landlord in connection with the rental agreement. The tenant has no customer relationship with Epicasa
beyond use of the platform.
Conditions for Using the Service
- The Service may only be used for properties located in Spain.
- Users must be 18 years or older. Legal entities may also use the Service.
- Landlords must have a Spanish NIE number.
- Epicasa reserves the right to refuse service to individuals or companies based on conduct, sanctions, or failure to meet verification requirements.
User Accounts
- To list or rent properties, users must register and maintain a valid account.
- Account holders must provide accurate, up-to-date information.
- Users are responsible for all activity on their account and must maintain the confidentiality of login credentials.
Listings and Advertising
- Listings must comply with all applicable laws, regulations, and agreements.
- Epicasa reserves the right to review, remove, or deny listings that violate its policies.
- Landlords agree not to change rent or terms after a tenant confirms intent to rent.
Rental Agreement
- A legally binding agreement is signed between the landlord and tenant.
- Epicasa provides a digital contract template but is not a party to it.
- The contract must specify monthly rent and payment terms.
Payments and Deposits
- All payments, including rent and deposits, are processed through Stripe.
- Epicasa does not collect or hold any payment funds.
- Landlords are solely responsible for depositing the security deposit with the appropriate regional housing authority in accordance with Spanish law.
Termination of Services
- Use of the platform does not constitute a continuous service. Once the rental agreement ends, so does the Service.
- Epicasa may suspend or terminate accounts for violation of terms or unlawful behavior.
Privacy and Data
- Use of the Service requires collection of certain personal data. This is handled per Epicasa's Privacy Policy.
- Identity verification may include BankID, ID upload, or other tools.
Limitation of Liability
- Epicasa makes no guarantees about the availability or accuracy of the Service.
- Users must perform their own due diligence.
- Epicasa disclaims all liability for property conditions, rental disputes, or legal issues between users.
Governing Law
- These terms are governed by Spanish law. Any dispute shall be resolved in a competent Spanish court.
The platform acts solely as a technical facilitator for transactions between tenants and landlords. The platform bears no responsibility for the management, reporting, or legality of the use of security deposits, and encourages all landlords to comply with local laws.
