1. General Terms
These terms were last updated on November 21, 2024, and apply to rental agreements signed via Epicasa from this date onwards.
Epicasa SL provides a marketplace for those who wish to rent or lease their property and offers the ability to sign digital rental agreements as well as a secure payment solution.
By using the Service, you accept these terms and agree to comply with them. If you register a company as a user, you certify that you have the authority to bind the company to these terms.
2. Definitions
- 'User' refers to any individual or entity using the Service.
- 'Landlord' refers to a User publishing a property for rent.
- 'Tenant' refers to a User applying for or renting a property.
- 'Service' refers to the digital platform provided by Epicasa.
3. Conditions of Use
The Service may only be used for properties located in Spain. Users must be 18 years or older. The Service can also be used by legal entities. Landlords must have a valid Spanish NIE number. Epicasa reserves the right to refuse service to individuals or companies who provide false information, misuse the Service, or fail to comply with these Terms.
4. Listings
To publish a property, Users must create an account and provide complete and accurate information. Users are responsible for ensuring listings comply with applicable laws and third-party obligations. Epicasa reserves the right to review, deny, or remove listings that violate the law or these Terms.
5. Rental Agreement
To use Epicasa’s secure payment solution, the landlord and tenant must sign the digital rental agreement provided via Epicasa. This agreement is strictly between the landlord and tenant; Epicasa is not a party to it. The agreement must reflect the details of the listing and comply with Spanish law. If the property is furnished, the landlord must document the included inventory.
6. Payments and Compliance
All rental payments and deposits for agreements initiated via Epicasa must be processed through Epicasa’s secure payment system. Direct payments between landlord and tenant outside the platform are strictly prohibited.
If a User circumvents this process, Epicasa will suspend or terminate the User’s account and block future access to the Service. Epicasa is not liable for any loss, damages, or disputes arising from direct payments made outside the platform.
By publishing a listing or signing a rental agreement on Epicasa, Users expressly accept that all financial transactions must be processed through Epicasa.
7. Tenant’s Payment Obligations
Tenants must pay Epicasa’s invoices on time. If payment is late, Epicasa may forward the matter to a debt collection agency. Epicasa has the right to full compensation for any damages, losses, or costs incurred due to non-payment, including legal and administrative costs.
Deposits must be paid to Epicasa in accordance with Epicasa’s instructions. The deposit may be used to cover unpaid rent or damages. At the end of the rental period, the deposit will be refunded unless the landlord raises objections within ten (10) days.
8. Prohibited Use
Users may not:
- Violate any laws or regulations.
- Circumvent Epicasa’s payment or contract processes.
- Attempt to manipulate or harm the Service.
- Copy or misuse information from Epicasa’s platform.
9. Limitation of Liability
Epicasa does not guarantee uninterrupted or secure access to the Service. To the extent permitted by law, Epicasa shall not be liable for damages arising from the use of the Service. Users are responsible for conducting their own due diligence regarding rental agreements and properties.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Spain. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
